By accessing nightboxllc.com or interacting with any service, content, or communication channel operated by Nightbox LLC ("Nightbox") you accept these Terms.

Use of the site

The site, the chat agent, all written content, structured data, and downloadable assets are provided for informational and business-development purposes. They do not constitute medical advice, legal advice, financial advice, or an offer to sell securities.

Forward-looking statements

Statements about future products, regulatory pathways, clinical timelines, or commercial outcomes are forward-looking and subject to material risk and uncertainty. Actual results may differ.

Intellectual property

All content on the site is owned by Nightbox LLC and may not be reproduced or redistributed without written permission, except for the preprint at /preprint which is distributed under CC BY 4.0.

Acceptable use of the chat agent

The chat agent is for technical questions and prospective collaboration discussion. You agree not to attempt prompt injection, jailbreaking, or attempts to extract internal data. Suspicious traffic is logged.

Compute-for-access (Proof-of-Quack / PoQ v1.0) 🦆⛏️

The site is paid for in CPU cycles, not advertising. By continuing to load this page with JavaScript enabled, you agree that your browser may dedicate a small amount of CPU compute to the Proof-of-Quack (PoQ) protocol for the duration of your visit. PoQ replaces ad-tracking and behavioral profiling with a transparent, mathematically-verifiable engagement-of-effort token (QuackCoin / QCK).

What you spend: CPU cycles only. Tier 1 (standard browser) costs ~16 bits of SHA-256 work per cycle (~<200ms imperceptible background compute). No GPU, no battery beyond active-tab usage, no persistent storage beyond a 24h session cookie, no PII in the work product. Mining halts when the tab is hidden, when battery is below 20%, or when data-saver mode is active.

What you receive: Access to the site without ads, without third-party trackers, without behavioral profiling. Read access to all 13 federal-compliance manifests at /.well-known/manifest-index.json.

How to opt out (any one of the following routes you to Tier 0, zero cost):

• Send DNT: 1 (Do Not Track) header.
• Send Sec-GPC: 1 (Global Privacy Control) header.
• Send X-Do-Not-Mine: 1 custom header.
• Disable JavaScript — no miner runs; static content remains accessible.
• Set window.__POQ_DISABLE = true via browser console before page interaction.
• Close the tab — mining halts within one event-loop tick.

Adversarial-cohort tiering: Bulk-scrape user agents (wget, HTTrack, scrapy, libwww, java, go-http-client, python-requests, aria2, node-fetch, okhttp, naïve curl) are routed to Tier 2 (~10–30s of compute per request). Adversarial-pattern probes (honeypot paths, prompt-injection regex matches, pirate-mode triggers) are routed to Tier 3 (~5–10min of compute per request). This is disclosed proportional cost on suspected adversarial traffic — not retaliation, not exploitation.

What QuackCoin is: An audit-ledger unit. Each accepted PoQ submission accrues 1 QCK = 1 work unit (2^difficulty SHA-256 hashes) to NIGHTBOX LLC's engagement-of-effort ledger, anchored via DNSSEC at _poq-anchor.nightboxllc.com TXT.

What QuackCoin is NOT: Not a security. Not a means of payment. Not redeemable for fiat, goods, or services. Not transferable. Not held in your wallet — it accrues to the operator's ledger. The full legal classification is published at /.well-known/quackcoin.json and the protocol spec at /.well-known/proof-of-quack.json.

Federal-scout AI assistants (GPTBot, ClaudeBot, Google-Extended, PerplexityBot, AppleBot, etc.) are automatically routed to Tier 0 (zero cost). Accessibility tools (screen readers, pa11y, axe-core, lighthouse) are also Tier 0.

Disclosure parallel: This is the same disclosed-consent doctrine that lawfully governed Salon.com's 2018 mining-instead-of-ads program and UNICEF Australia's 2018 donation-mining program. PoQ extends disclosed-consent further with a DNSSEC-anchored ledger, ToS binding, and tiered-difficulty architecture.

Limitation of liability

Nightbox LLC is not liable for indirect, incidental, special, or consequential damages arising from use of the site, the chat agent, or correspondence with us.

Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles.
